Terms of Service

1. Who we are

“SpotBase” (“we”, “us”) is the platform that helps you log and analyze aircraft spotting data. These Terms are an agreement between you and the SpotBase operator (insert your legal entity name & address).

2. Using the Service

You must be at least 13 years old (or the age of digital consent in your country) to use the Service. You agree to comply with these Terms and all applicable laws. We may update, suspend, or discontinue any part of the Service at any time.

3. Accounts & Security

• You’re responsible for your account and any activity on it.
• Keep your credentials secure; don’t share your account.
• Tell us immediately if you suspect unauthorised access.

4. Subscriptions & Billing

Some features are free; Premium features require a paid subscription. Payments are processed by a Merchant-of-Record (e.g., Lemon Squeezy or Paddle). They handle taxes (including GST/VAT where applicable), receipts, and chargebacks. Your subscription renews automatically until you cancel.

5. Cancellations & Refunds

• You can cancel at any time via Settings → Billing. Access continues until the end of the current period.
• We offer a 14-day money-back guarantee on your first purchase unless prohibited by law.

6. Your Content & Permissions

You retain ownership of logs, photos, and other content you submit. You grant us a worldwide, non-exclusive license to host, process, and display your content to operate and improve the Service. You’re responsible for the content you submit and for having the rights to do so.

7. Allowed Content (Aircraft Only) & Content Policies

SpotBase is dedicated to aircraft spotting. To keep the platform focused and safe:

• Aircraft-only uploads: Photos, videos, and logs must be primarily of aircraft (airframes, liveries, aviation details). Other vehicles, general scenery, or unrelated subjects are not allowed.
• No people-identifying content: Avoid close-up faces, name badges, or other personally identifying images without consent.
• Sensitive & illegal content: No gore, graphic injury, hate symbols, extremist propaganda, harassment, illegal activity, or instructions that facilitate harm or lawbreaking.
• Safety & access: Don’t trespass, interfere with airport operations, or endanger yourself/others to obtain content.
• Privacy & data: Don’t post private information (IDs, tickets, addresses, phone numbers, access badges) or confidential markings.
• IP/copyright: Only upload content you own or have the right to share. Respect trademarks and livery IP; editorial/spotting use only.
• Spam & quality: No spam, deceptive metadata, or bulk low-effort posts that degrade experience. Keep captions and tags relevant.
• Moderation: We may remove content, restrict visibility, or take action (including bans) for violations. You can appeal via Contact.

8. Acceptable Use

• No illegal, infringing, or harmful activity.
• No scraping, rate-limit bypassing, or service disruption.
• No uploading of malicious code or violating privacy rights.
• No misrepresentation or unauthorised commercial use.

9. Intellectual Property

The Service (software, design, trademarks, and content we provide) is protected by IP laws. Except for the rights expressly granted to you, we reserve all rights.

10. Privacy

Our use of your data is described in our Privacy Policy. By using the Service, you consent to that processing.

11. Third-Party Services

We may integrate with third-party services (e.g., payment processors, analytics, maps). Their terms and privacy policies apply to your use of those services. We’re not responsible for third-party acts or omissions.

12. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, and non-infringement). We do not guarantee uninterrupted or error-free operation or that data will be preserved without loss.

13. Liability Limit

To the fullest extent permitted by law, we (and our suppliers) will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, data, goodwill, or business interruption. Our total liability for any claim relating to the Service is limited to the amounts you paid to us for the Service in the 12 months before the event giving rise to the claim.

14. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, and expenses (including legal fees) arising from your use of the Service or your breach of these Terms.

15. Changes to These Terms

We may modify these Terms. If we make material changes, we’ll provide notice (e.g., email or in-app). Continued use after the effective date means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of Western Australia. Courts in Perth, WA will have exclusive jurisdiction, except where local law requires otherwise.
